INVICTUS GAMES 2027 CHAMPIONS PROGRAMME TERMS AND CONDITIONS
Version 2.0 – 09 July 2027
These terms and conditions (“Terms”) govern your participation as an eligible small or medium-sized enterprise (“SME”) in the Invictus Games Birmingham 2027 Champions Programme (the “Champions Programme”) operated by Invictus UK 2027 Limited (“IUK2027”).
The Champions Programme is a business recognition programme through which eligible SMEs may show their support for the Invictus Games Birmingham 2027. Accepted participants in the Champions Programme receive the benefits applicable to their selected Tier, including limited permission to use the Champions Marks in accordance with these Terms.
By completing the online application form and accepting these Terms, you agree to be bound by them.
Definitions and Interpretation
In these Terms, unless the context otherwise requires, the following words and expressions have the following meanings:
"Brand Guidelines" means the branding and usage guidelines issued by IUK2027 from time to time.
"Champions Marks" means the logos, marks, names and other branding materials relating to the Champions Programme made available by IUK2027.
"Champions Programme" means the Invictus Games 2027 Champions Programme operated by IUK2027.
"Participation Fee" means the fee payable by you for participation in your selected Tier.
"Tier" means Bronze, Silver or Gold level participation in the Champions Programme, as selected by you and accepted by IUK2027.
"Tier Benefits" means the benefits, rights and recognition applicable to your selected Tier as set out in Annex A.
2. Eligibility Criteria
2.1 You confirm that you are a UK-incorporated company and meet the UK Government’s definition of small enterprise, namely that you satisfy at least two (2) of the following criteria:
50 employees or fewer,
£7.4 million or less on your balance sheet,
£14.9 million or less in annual turnover.
2.2 You confirm you are not part of a group of companies which, taken together, would exceed these thresholds.
2.3 Companies operating in, or affiliated with, the following sectors are not eligible to participate in the Champions Programme:
Gambling
Pornography
Any other sectors as may be prohibited by IUK2027 in its sole discretion acting reasonably and at its sole discretion.
3. Application and Acceptance
3.1 By completing the online form and submitting payment of the relevant Champions Programme participation fee, you are applying to become a Bronze, Silver or Gold Champion of IUK2027, under the Champions Programme and agree to abide by these Terms.
3.2 IUK2027 reserves the right to refuse any application for any reason.
3.3 Participation in the Champions Programme shall commence only once IUK2027 has confirmed acceptance of your application in writing (including by email).
4. Programme Benefits and Brand Usage
4.1 Subject to:
payment of the applicable Champions Programme participation fee;
acceptance of your application by IUK2027; and
your continued compliance with these Terms, you shall be entitled to receive the benefits applicable to your selected Tier (Bronze, Silver or Gold) as set out in Annex A.
As one of those benefits, IUK2027 grants you a limited non-exclusive, non-transferable, and revocable licence to use the IUK2027 Champions Programme certification mark(s), logos and related materials (“Champions Marks”) applicable to your selected Tier solely during your participation in the Champions Programme and strictly in accordance with:
these Terms;
the Brand Guidelines published by IUK2027 (as updated from time to time); and
the rights and benefits applicable to your selected Tier.
4.2 Champions Marks may only be used on your corporate website, company letterhead, and corporate marketing materials (but not advertising in any form of public media). Use on merchandise, promotional items, corporate videos, advertising, clothing, packaging, giveaways, shopfronts, company premises or any other use is strictly prohibited.
4.3 You may not apply any Champions Mark to products or use the Marks in any manner which could imply endorsement of your products or services by IUK2027.
4.4 The Champions Marks and any rights or benefits granted under this Champions Programme may not be sublicensed, transferred, assigned, or otherwise made available to any third party (including affiliates, group companies or subsidiaries).
4.5 IUK2027 shall require prior written approval of any proposed use of the Champions Marks and any associated marketing, promotional or public relations materials. You shall promptly comply with any reasonable request by IUK2027 to amend, withdraw or cease use of such materials.
5. Representation of Participation
5.1 You may describe your organisation as an “Invictus Games 2027 Bronze Champion”, “Invictus Games 2027 Silver Champion” or “Invictus Games 2027 Gold Champion (as applicable) and as a participant in the Invictus Games 2027 Champions Programme, provided such description is accurate and complies with these Terms and the Brand Guidelines.
5.2 You must not describe yourself or imply in any way that you are:
an Official Sponsor of the Invictus Games;
an Official Partner of the Invictus Games;
a commercial partner of IUK2027; or
otherwise affiliated with IUK2027 or the Invictus Games beyond your participation in the Champions Programme.
All representations must accurately reflect your selected Tier and the scope of your participation.
6. Conduct and Reputational Safeguards
6.1 You warrant that you have not and will not engage in any unlawful, immoral or unconscionable conduct which, in IUK2027’s reasonable opinion, brings, or is likely to bring, IUK2027, the Invictus Games or the Champions Programme into disrepute.
6.2 In the event of a breach of these Terms (including this clause), IUK2027 reserves the right to suspend or revoke your participation in the Champions Programme and your permission to use the Champions Marks with immediate effect and without any refund.
6.3 You shall comply with all applicable laws, regulations and industry codes in connection with participation in the Champions Programme.
6.4 You warrant that you have not committed and shall not commit offences under anti-bribery, anti-fraud or modern slavery legislation.
6.5 Any breach of this clause constitutes a material breach of these Terms and may result in immediate termination of your participation in the Champions Programme without refund.
7. Intellectual Property
7.1 All intellectual property rights in and to the Invictus Games, IUK2027 and Champions Marks (together, the “IUK2027 IP”) are and shall remain the exclusive property of IUK2027.
7.2 No rights are granted to you other than as expressly set out in these Terms. Participation in the Champions Programme does not transfer to you any ownership or proprietary rights in the IUK2027 IP. You agree not to use or register any trademark, domain name, or other right that is identical or confusingly similiar to any IUK2027 IP.
7.3 You shall not do or omit to do anything which may weaken, damage or adversely affect the goodwill, reputation or distinctiveness of IUK2027 IP.
7.4 You shall promptly notify IUK2027 of any actual or suspected infringement or misuse of the IUK2027 IP.
8. Tier-Based Rights and Benefits
8.1 Participation in the Champions Programme entitles accepted participants to receive the rights, benefits and recognition associated with the Tier for which they have registered (Bronze, Silver or Gold), as set out in Annex A. Participants may only use the rights, benefits, messaging and Champions Marks applicable to their selected Tier.
8.2 IUK2027 may make reasonable amendments to the Champions Programme, including the benefits available under each Tier, where operational, commercial or legal requirements make this necessary, provided that the overall nature of the Champions Programme is not materially altered.
9. Fees and Refunds
9.1 The applicable Champions Programme participation fee for your selected Tier must be paid in full at the time of application.
9.2 All Champions Programme participation fees are non-refundable, regardless of whether you exercise your rights under the Champions Programme or your participation is terminated as a result of a breach of these Terms.
9.3 If IUK2027 declines your application before accepting you into the Champions Programme, any participation fee paid will be refunded in full.
10. Data Protection
10.1 IUK2027 will collect and process personal data submitted by you as part of the application and participation in the Champions Programme in accordance with its Privacy Policy and applicable data protection law (including the UK GDPR and Data Protection Act 2018).
10.2 Such data may be used for:
administration of the Champions Programme;
communications relating to the Champions Programme and IUK2027; and
publicly identifying and promoting your organisation as a participant in the Champions Programme, unless you opt out.
10.3 You confirm that any personal data you provide in your application has been lawfully obtained and you have all necessary consents and permissions to provide such data to IUK2027.
11. Termination and Withdrawal
11.1 IUK2027 may terminate your participation in the Champions Programme immediately if:
(i) you breach these Terms;
(ii) you become subject to an insolvency event;
(iii) you engage in conduct which, in IUK2027’s reasonable opinion, may adversely affect the reputation of IUK2027, the Invictus Games or the Champions Programme;
(iv) you cease to meet the eligibility criteria set out in Clause 2.
11.2 You may withdraw from the Champions Programme at any time by written notice to IUK2027 but shall not be entitled to any refund of the Champions Programme participation fee.
11.3 Upon termination or expiry of your participation in the Champions Programme:
all rights and benefits associated with your participation shall immediately cease;
you must immediately cease representing yourself as a participant in the Champions Programme;
you must cease all use of the Champions Marks; and
you must remove the Champions Marks from your website, digital platforms and any future corporate communications as soon as reasonably practicable.
12. Confidentiality
12.1 Each party shall keep confidential any confidential information disclosed in connection with the Champions Programme and shall not disclose such information to any third party except:
where disclosure is required by law;
to its professional advisers;
or with the prior written consent of the other party.
This obligation shall survive termination of these Terms.
13. General
13.1 These Terms are governed by English law and the courts of England and Wales shall have exclusive jurisdiction.
13.2 No waiver or delay in either party in exercising any right or remedy under these Terms shall constitute a waiver of that or any other right or remedy.
13.3 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13.4 IUK2027 reserves the right to make reasonable amendments to the Champions Programme, these Terms and the Brand Guidelines where necessary for legal, regulatory, operational or commercial reasons. Updated Terms shall take effect upon publication or notification to participants.
13.5 These terms, together with the online application form, Annex A and the Brand Guidelines, constitute the entire agreement between the parties relating to participation in the Champions Programme and supersede any prior discussions or representations relating to the Programme.
13.6 Participation in the Champions Programme does not create a partnership, joint venture, agency, employment relationship or exclusive commercial relationship between the parties.

Gold Champion – £3,000 +VAT
