INVICTUS GAMES 2027 CHAMPIONS PROGRAMME
TERMS AND CONDITIONS
These terms and conditions (“Terms”) govern your participation as an eligible SME (“ small or medium -sized enterprise) (“you” ) in the Invictus Games 2027 Champions Programme (“Champions Programme”) operated by Invictus UK 2027 Limited ( “IUK2027”).
By completing the online application form and accepting these Terms, you agree to be bound by them.
1. Eligibility Criteria
1.1 You confirm that you are a UK-incorporated company and meet the UK Government’s definition of small enterprise , namely you satisfy at least two of the following criteria:
· 50 employees or fewer,
· £7.4 million or less on your balance sheet,
· £14.9 million or less in annual turnover.
1.2 You confirm you are not part of a group of companies which, taken together, would exceed these thresholds.
1.3 Companies operating in, or affiliated with, the following sectors are not eligible to participate in the Champions Programme:
· Gambling
· Pornography
· Any other sectors as may be prohibited by IUK2027 in its sole discretion.
2. Application and Acceptance
2.1 By completing the online form and submitting payment of the relevant licence fee, you are applying to become a Bronze, Silver or Gold Champion of IUK2027, and agree to abide by these Terms.
2.2 IUK2027 reserves the right to refuse any application for any reason.
3. Use of Champions Marks and Rights
3.1 Subject to compliance with these Terms, payment of the relevant fee and acceptance of your application (as may be notified to you by email) IUK2027 grants you a non-exclusive, non-transferable, revocable licence to use the IUK2027 Champions Programme certification mark(s) and related materials (“Champions Marks”) applicable to your chosen tier (Bronze, Silver, Gold) solely for the duration of the ChampionsProgramme and strictly in accordance with:
· The style and usage guidelines published by IUK2027 at the time of your application and as may be updated from time to time;
· The rights and benefits outlined in the Champions Programme Tier Table (see Annex A).
3.2 Champions Marks may only be used on your corporate website, company letterhead, and corporate marketing materials (but not advertising in any form of public media). Use on merchandise, promotional items, corporate videos, advertising, clothing, packaging, giveaways, shopfronts, company premises or any other use is strictly prohibited.
3.3 You may not apply any Champions Mark to products or use the Marks in any manner which could imply endorsement of your products or services by IUK2027.
3.4 The Champions Marks and any rights or benefits granted under this Champions Programme may not be sublicensed, transferred, assigned, or otherwise made available to any third party (including affiliates, group companies or subsidiaries).
4. Sponsorship and Representation Restrictions
4.1 You must not describe yourself or imply in any way that you are a sponsor, official partner, or affiliated with IUK2027 beyond participation in the Champions Programme.
4.2 All representations must accurately reflect the Tier and scope of your participation.
5. Conduct and Reputational Safeguards
5.1 You warrant that you have not and will not engage in any unlawful, immoral or unconscionable conduct which IUK2027 deems in its absolute discretion to bring its brand, or the Invictus Games into disrepute through your association with the Champions Programme.
5.2 In the event of a breach of these Terms (including this clause), IUK2027 reserves the right to revoke your licence to use the Champions Marks with immediate effect and without any refund.
6. Intellectual Property
6.1 All intellectual property rights in and to the Invictus Games, IUK2027 and Champions Marks (together, the “IUK2027 IP”) are and shall remain the exclusive property of IUK2027..
6.2 No rights are granted to you other than as expressly set out in these Terms. You agree not to use or register any trademark, domain name, or other right that is identical or deemed confusingly similar to any IUK2027 IP.
7. Tier-Based Rights and Benefits
7.1 You agree to comply strictly with the rights, benefits, and obligations associated with the Yier for which you have registered (Gold, Silver or Bronze), as outlined in the Champions Programme Tier Table (Annex A). Use of any marks, messaging or benefits outside of your licensed Tier is strictly prohibited.
8. Fees and Refunds
8.1 The applicable licence fee for your chosen Yier must be paid in full at the time of application.
8.2 All fees are non-refundable, regardless of whether or not you exercise your rights under the Champions Programme or are removed due to breach of these Terms.
9. Data Protection
9.1 IUK2027 will collect and process personal data submitted by you as part of the application and participation in accordance with its Privacy Policy and applicable data protection law (including the UK GDPR and Data Protection Act 2018).
9.2 Such data may be used for the administration of the Champions Programme, communications related to IUK2027 and to promote your company as a participant unless you opt out.
9.3 You confirm that any personal data you provide in your application has been lawfully obtained and you have all necessary consents.
10. Termination and Withdrawal
10.1 IUK2027 may terminate your participation and revoke your licence at any time with immediate effect upon (i) breach of these Terms, (ii) in the event that you become insolvent, or (iii) for any conduct that may, in its sole opinion, adversely affect the reputation of the Invictus Games.
10.2 You may withdraw from the Champions Programme at any time by written notice but shall not be entitled to any refund of fees.
11. General
11.1 These Terms are governed by English law and the courts of England and Wales shall have exclusive jurisdiction.
11.2 No waiver or delay in enforcing any right shall be deemed a waiver of any further rights.
11.3 If any provision is found unenforceable, the remainder shall continue in force.
